1. Acceptance of Terms

By accessing or using Starv Forge, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not access the service.

2. Service Description

Starv Forge is an AI-powered platform designed to help businesses and entrepreneurs generate:

  • Marketing Strategies: Detailed plans and tactical suggestions.
  • Brand Profile: Customization of AI identity based on your niche and goals.
  • Image Generation: Creation of visuals using advanced AI models.
  • Sales Scripts and Content: Copywriting optimized for various channels.
  • Magic Autocomplete: Extraction of brand identity directly from a provided URL.

AI Notice:Starv Forge services use artificial intelligence models (such as Google Gemini). While we strive for accuracy, AI can make mistakes. You are responsible for reviewing and verifying all generated content before using it in your business.

3. User Accounts

To access certain features, you must register and create an account. You are responsible for maintaining the confidentiality of your password and account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions, Payments, and Refunds

Starv Forge offers its service under subscription plans (e.g., Pro and Deluxe). All payments are processed securely through our authorized payment providers (such as Stripe or Creem). We do not directly store your credit card information.

  • Billing: Subscriptions renew automatically at the end of the period (monthly or annual) according to the selected plan, unless you cancel before the cutoff date.
  • Refund Policy: Due to the digital nature of the service and the high intrinsic costs of Artificial Intelligence processing ('tokens'), we do not offer refunds or prorated returns for unused periods after the charge.
  • Generation Credits: Credits granted monthly for Image generation are not cumulative. At the start of the next billing cycle, they will reset to their default base amount.

Fraud Protection and Chargebacks:The deliberate and unjustified attempt to reverse funds through your banking entity (after having consumed our AI services) is considered limiting fraud. Such action will result in the immediate and permanent blocking of your business account, the loss of all generated content, and could veto future registrations under the same identifiers in our payment protection systems. If you have any problems, contact support before issuing bank claims.

5. Intellectual Property and AI Use

Your Content and Identity

You retain all rights to your business information, including logos, URLs, and identity settings you provide.

Generated Content and Images

Starv Forge grants you a commercial use license over the content and images generated by the platform for your business, subject to compliance with your subscription plan.

5.1 Restrictions and Voice Filters

By using the 'Voice Filters' feature, you are solely responsible for the restricted words you define. Starv Forge is not responsible if such filters omit critical information or alter the legal meaning of your messages.

5.2 Image Generation and Credits

Image generation is subject to monthly credit limits according to your plan (Pro or Deluxe). Credits are not cumulative month to month. Use of generated images must comply with our AI model providers' ethics policies.

5.3 Prohibited Content and Safe Use (NSFW)

Starv Forge strictly prohibits the generation of content (text or images) that is:

  • NSFW or Sexually Explicit: Creation of any adult content or content of a sexually explicit nature is prohibited.
  • Illegal or Harmful: Content that incites violence, discrimination, hate, or criminal activities.
  • Rights Infringement: Content that violates the privacy or intellectual property of third parties.

Failure to comply with these rules will result in immediate account suspension without the right to a refund, in accordance with our safety policies and those of our payment processors.

6. Limitation of Liability

To the maximum extent permitted by law, Starv Forge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of your use of the service.

We do not guarantee specific sales results or business growth derived from the use of our suggestions or content.

7. Changes to Terms

We reserve the right to modify or replace these terms at any time. We will attempt to provide reasonable notice before new significant terms take effect.

8. Applicable Law and Jurisdiction

These Terms of Service are governed by, interpreted, and applied under the laws of the Republic of Peru.

For any conflict, claim, or legal dispute arising from the use of the Starv Forge platform, both parties agree to submit exclusively to the jurisdiction and competence of the corresponding courts in the city of Lima, Peru, expressly waiving any other jurisdiction that might correspond to them by reason of their present or future addresses.
